Please read these Terms of Service (“Terms”) carefully before using the Obbie Discord Bot (“Obbie”) developed by JewelEyed. By using Obbie, you agree to be bound by these Terms, including the acceptance of Discord’s Terms of Service. If you do not agree with any part of these Terms, do not use Obbie.
1. Use of Obbie
1.1 Obbie is a third-party bot designed to enhance user experience on Discord. By using Obbie, you acknowledge and agree that JewelEyed has no control over Discord’s platform, services, or policies.
1.2 You must have a valid Discord account to use Obbie. You are responsible for complying with Discord’s Terms of Service (https://discord.com/terms) and any other applicable rules or policies, such the developer policy
1.3 You must be at least 13 years old to use Obbie. If you are under the age of 13, you may not use Obbie.
2. Privacy Policy
2.1 Obbie may collect and store certain data to provide its services effectively. This data may include but is not limited to server settings, user IDs, and other relevant information necessary for Obbie’s functioning.
2.2 By using Obbie, you grant JewelEyed permission to collect, store, and process your data in accordance with applicable privacy laws and regulations.
3. Limitations of Liability
3.1 No Warranty: Obbie is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. JewelEyed disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
3.2 Limitation of Liability: To the maximum extent permitted by applicable law, JewelEyed and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of Obbie.

Indemnification
4.1
You agree to indemnify and hold JewelEyed and its affiliates harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in connection with your use of Obbie, your violation of these Terms, or your violation of any rights of any third party.
5. Miscellaneous
5.1
Modification of Terms: JewelEyed reserves the right to modify these Terms at any time. Any changes to the Terms will be effective immediately upon posting the revised Terms on the platform where Obbie is made available. Your continued use of Obbie after the posting of the revised Terms constitutes your acceptance of such changes.
5.2
Termination: JewelEyed may, in its sole discretion, terminate or suspend your access to Obbie, without prior notice or liability, for any reason whatsoever, including but not limited to your breach of these Terms.
5.3
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state of Arizona.
5.4
Entire Agreement: These Terms constitute the entire agreement between you and JewelEyed regarding your use of Obbie and supersede any prior agreements between you and JewelEyed.

Please note that these Terms are subject to Discord's Terms of Service, and any conflicts or discrepancies between the two shall be resolved in favor of Discord's Terms of Service.
